Terms and Conditions

Agreement

Thank you for choosing to book with Bramble Bottom Holidays (BBH). The agreement is made with the lead booker.

By accepting these Terms and Conditions, you agree that you are over 18 years of age and that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the property during your holiday. If payment is made by credit/debit card by telephone, you will have deemed to have read all the Terms and Conditions and agreed to be bound by them.

Booking

When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide on the booking form. This does not form a contract between us. A contract shall only arise when your booking is subsequently confirmed in writing via a letter of confirmation sent to you by email.

If your holiday is more than eight weeks from the date of booking, we will require a deposit of 30% of the total booking value. If the holiday is due to start within eight weeks of the booking, the total of the holiday rental fee is payable at the time of booking.

BBH will confirm your booking on receipt of the appropriate deposit or full payment. Once BBH has confirmed your booking and has received the deposit or full payment, then an agreement exists between us on these Terms and Conditions. A copy of these Terms and Conditions will be sent to you in a separate email to the Booking Confirmation/Receipt. If you have any issue with the Terms and Conditions, please contact us within 48 hours and receive a full refund on any monies paid.

Final Payment

The balance of the holiday rental fee less any deposit will become due eight weeks before the start of your holiday. If the balance is not received on time, BBH reserves the right to cancel your booking and retain the deposit.

Changes to your Booking

If you wish to make any changes to your booking, please contact us and we will endeavour to assist wherever possible but cannot guarantee this.

Occupation of the Property

The number of people occupying the property must not exceed that given on the Booking Form. We reserve the right to refuse admittance if this condition is not observed. Only members of your party are permitted to use the facilities at Bramble Bottom.

You must not use the property for any activity or in such a way as to cause nuisance or annoyance to BBH or its neighbours.

COVID Cancellation Policy

If your booking has to be cancelled because of a national lockdown and the lockdown period covers the dates of your booking, you will be refunded in full.

If the address of the lead booker is put into local/regional lockdown and the lockdown period covers the dates of your booking, meaning you are unable to travel, you will be refunded in full should the rest of your party not wish to continue with the booking. However, if the address of other members of the party is put into local/regional lockdown, you will not be entitled to a refund.

Covid is now a known risk and it is possible to insure your holiday against it. This can include the lead booker or any of the party having Covid, having to self-isolate or quarantine, or you wishing to shield any members of the party.

Therefore, if you – or any members of your party – catch COVID prior to your holiday or you are required to self-isolate/quarantine/ shield, you will need to claim on your travel insurance (see below)

General Cancellation Policy

If we cancel your holiday:

BBH reserves the right to cancel your booking at any time in the event of circumstances beyond our reasonable control or if in the reasonable opinion of BBH, it is necessary to undertake essential works at the property. In these unlikely circumstances, BBH will endeavour to offer a suitable alternative holiday. If no such alternative holiday is agreed between us, then we will refund in full all money received by us for the booking. BBH will not otherwise be liable for any loss incurred by you as a result of the cancellation.

If you cancel your holiday:

When you book Bramble Bottom, you are booking a property suitable for up to ten people. If you or any of your party are unable to travel or are disinclined to travel, you must notify BBH of your cancellation request in writing. We will do our utmost to relet the
property – if we are successful at reletting at the same price you paid, we will refund you any monies already paid less an admin fee of £50.00. If we need to reduce the holiday price in order to relet it, you will receive the reduced sum rather than the amount you paid. If we cannot relet your holiday dates, you will not be entitled to a refund of any monies paid and you will need to claim on your travel insurance.

Reasons for cancellation include – but are not limited to – illness, jury service, family emergencies, military service, a change in personal or work circumstances, travel delays (including public transport) or vehicle breakdown.

These issues are at your own risk and do not entitle you to cancel or receive a refund. We strongly recommend that you take out travel insurance to cover you for such eventualities (see below).

Travel Insurance

As with any other holiday, we strongly recommend that you take out appropriate travel insurance cover for your holiday in case you have to cancel your booking for any reason other than Covid lockdowns as stated previously. For a small additional fee, you can arrange refund protection via our online booking provider with Booking Protect. Please read their Terms and Conditions carefully before booking this protection. Please note your refund protection contract is with Booking Protect and not with BBH. Booking Protect does not provide Covid refund cover.

Many banks and building societies offer free annual travel insurance policies to account holders.

In addition, there are a number of travel insurance policies that will also refund for some Covid related issues.

Your Obligations

You agree to keep the property and its contents in the same condition and repair as on your arrival at the property and to pay to BBH upon written demand any costs incurred in making good any loss or damage to the property or its contents caused by your
action or omission or that of any guest or animal accompanying you.

No pet is permitted at the property other than any dogs notified to us on the Booking Form. You must keep dogs off the furniture and under proper control at all times. Please be aware that Bramble Bottom is located in a sheep farming area and you should bear this in mind at all times.

You must allow anyone from BBH to enter the property during your holiday in the case of an emergency, e.g. a burst water pipe. BBH reserve the right to enter the property in your absence in such circumstances.

You must ensure that the property is left in a clean and tidy condition on your departure at the end of your holiday. BBH may make a charge for any additional cleaning if this is considered necessary.

Our Right to Terminate a Booking

BBH reserves the right to terminate this Agreement and ask you and your guests to leave immediately if this is deemed necessary as a result of your behaviour or that of your guests or any other material breach by you of the terms of this Agreement.

Arrival and Departure

The holiday rental period begins at 4.00pm on the first day of the booking period and ends at 10.00 on the day of departure. This is essential if BBH is to prepare the property to the appropriate standard prior to guest arrivals. If your stay extends beyond this
period, you may be subject to an additional charge.

Description and Facilities

BBH will endeavour to inform you at the time of booking of any changes to the website description of the property or any events/ works taking place near the property during your stay (e.g. a scheduled electricity outage). BBH does not accept any liability for
any works or activity of any sort occurring near the property during your stay nor for unforeseen issues such a power cut.

Wifi

Guests agree to reasonable and lawful use of the wifi provided.

Smoking

Smoking is strictly forbidden in all indoor areas. If you do smoke outside, please dispose of any cigarette butts in the outside bin and not the bin inside the cottage.

Tenancy

This agreement is for the purpose of a holiday rental only and does not create the relationship of Landlord and Tenant between you and BBH. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this

Lost Property

BBH shall not be responsible for loss or damage to any of your belongings or for any injuries sustained by you or any of your party unless caused by the negligence or default of BBH.

Electric Vehicles

Please note that there is no charging point at Bramble Bottom and on no account are guests permitted to use the electric sockets at the property for this purpose. There is a charging point at the National Park Centre in Hawes (approximately six miles from the properties).

Complaints

If you have any cause for complaint during your holiday at the property, please notify BBH at the time and we will make all reasonable efforts to assist and resolve the issue. BBH will not normally make any refund or recompense in respect of a complaint
made after departure if the complaint was not made known during the holiday rental period.

Updates to our Terms and Conditions

We reserve the right to update/amend these Terms and Conditions. The Terms and Conditions at the time of your actual booking will be the ones that apply to your booking.
